Made by DH is the independent design and engineering studio of Dave Hughes — a sole-operated practice. On this page, “Made by DH,” “we,” and “us” mean Dave Hughes d/b/a Made by DH; “the site” means this marketing website at madebydh.com and its contact form; and “services” means the professional design and development work we agree to in a separate written contract — not the act of browsing this site. Terms of Use

1. Using this site.

By visiting madebydh.com or sending a message through it, you accept these Terms. If they don’t work for you, please don’t use the site.

2. What we do here.

Made by DH designs and builds websites, web apps, e-commerce stores, and MVPs, and sets up SEO and GEO so businesses get found on Google and in AI search. This site exists to explain that work and let you get in touch. The scope, price, timeline, and ownership for any paid project live only in a separate written agreement (a Master Services Agreement and Statement of Work) — never on this site alone.

3. The site by itself doesn’t promise anything.

Nothing here is a guarantee of availability, results, or an engagement. We reply to enquiries at our discretion, and examples of past work don’t guarantee the same outcome for your project.

4. Your part.

Please give accurate information when you use the contact form, and use the site lawfully. Don’t try to break, probe, or otherwise misuse it.

5. Our site content is ours.

The text, design, code, graphics, and logos on this site belong to Made by DH or are used with permission, and are protected by copyright. Please don’t copy, republish, or build derivatives from them without our written OK — sharing a normal link is always fine.

6. Work we build for clients.

For paid projects, who owns what — code, designs, configurations — is set out in the contract you sign, not here. Browsing this site or sending a message doesn’t create a client relationship on its own.

7. Limitation of liability.

To the fullest extent the law allows, Made by DH isn’t liable for indirect, incidental, or consequential losses arising from your use of this site. For any claim relating to the site itself, our total liability is capped at US $100. (Liability for paid project work is governed by your signed contract, not by this cap.)

8. Indemnification.

To the extent the law allows, you agree to cover Made by DH for claims, losses, or costs (including reasonable legal fees) that arise from your misuse of the site or your breach of these Terms — except to the extent we caused the problem.

9. Changes.

We may update the site or these Terms at any time. Continuing to use the site after a change means you accept the update.

10. Governing law.

These Terms are governed by the laws of the State of Colorado, USA.

Privacy Policy

1. Who’s responsible.

Made by DH (Dave Hughes), based in Colorado, USA, is responsible for the information described here. Contact: [email protected].

2. What we collect — and it’s very little.

• What you send us. When you use the contact form: your name, your email address, and whatever you write in your message.
• Basic, anonymous usage data. Privacy-first analytics that count visits and page views so we can improve the site. This is aggregate only — it doesn’t use cookies, doesn’t track you across other sites, and doesn’t build a profile of you.

3. Our analytics are cookieless.

We use Cloudflare Web Analytics, which measures traffic — page views, referrers, rough country, device type — without cookies and without collecting personal information or fingerprinting you. There’s no advertising network and no tracking pixel on this site.

4. How we use what you send.

We use your contact-form details only to read and reply to your enquiry and to follow up about a possible project. We don’t sell your information, and we don’t use it for advertising. We may also act on it to prevent spam or abuse, or to meet a legal obligation.

5. Who else touches the data.

Only the services that run the site for us:

• Cloudflare — hosts the site and provides the cookieless analytics described above.
• Resend — delivers your contact-form message to our inbox as an email.

Each only handles your information to do its job for us. Your enquiry then lands in our own email inbox, where we read and reply to it. We may disclose information if the law requires it.

6. How long we keep it.

We keep enquiry emails for as long as we’re in touch about a project and for a reasonable period afterward — usually around two years after our last contact — unless we need them longer for legal or accounting reasons. Analytics data is anonymous and aggregate, retained per Cloudflare’s settings.

7. Your choices.

Email [email protected] to ask what we hold about you, or to correct or delete it, and we’ll help. Depending on where you live, you may also have rights to access, delete, or restrict how your information is used.

8. No cookie banner — because no tracking cookies.

This site doesn’t set advertising or tracking cookies, so there’s nothing for you to consent to. Your browser settings stay fully in your control.

9. Children.

The site and our services are meant for businesses and aren’t directed to anyone under 18. We don’t knowingly collect information from children.

10. Visitors outside the US.

Made by DH is based in the United States, and your information is processed here. If you’re visiting from another country, you’re sending your information to the US, where data-protection rules may differ from your own.

11. Changes.

If we update this policy, we’ll post the new version here with a new “last updated” date.
